Warranty, Freight Policies, and Terms & Conditions

This Hekman Contract Warranty is our quality product promise and a performance commitment to our customers.

WARRANTY:

Hekman Contract products are warranted to be free from defects in material and workmanship from the date of purchase for a period of ten years. This warranty specifically excludes fabrics, vinyl, “customer’s own material” (COM) and other textile materials. This warranty does not include damage to product or components resulting from abuse, accident, alteration, climatic/environmental conditions, damage resulting from normal wear and tear, lack of care and cleaning, misuse, issues caused during installation, freight damage, or unauthorized repair. Hekman Contract does not warrant natural variations in wood grain or changes in surface finishes due to aging or exposure to light. This warranty extends only to the original purchaser. Hekman Contract will repair or replace at its option the product or component.
  • Dining chairs are warranted for two years.
  • Casters are warranted for three years.
  • Back cushions are warranted for one year.
  • Seat cushions are warranted for five years.
  • Swivel, rocker, and glider mechanisms are warranted for one year.
  • Power recliner mechanisms are warranted for one year.
  • Healthcare casegoods are warranted for three years.
  • ThermoShield tops are warranted for three years.
  • Tables are warranted for one year.
  • Floor clocks are warranted for two years.
  • All other clocks are warranted for one year.
  • TV consoles and home storage cabinets are warranted for one year.
  • In-stock collections are warranted for one year.

If you suspect there is a warranty issue, please contact your Hekman Contract Customer Service Rep or support@hekmancontract.com for assistance. Please provide photos of the issue, of any labels on the item, po numbers/order numbers, etc. to help us determine the issue and advise the corrective action needed.

MERCHANTABILITY:

Hekman Contract makes no representations regarding the merchantability or fitness for a particular purpose for any product. The purchaser assumes all responsibility for the determination of suitability for intended use.

FREIGHT DAMAGE:

By accepting our product for shipment, the carrier acknowledges that the product is in First Class condition. By signing (or someone else signing on your behalf) to accept the shipment, you acknowledge that the product has been received in the same First Class condition as shipped. If the carton is crushed or otherwise damaged, instruct the driver to note the damage on the freight bill. File a claim immediately with the carrier and retain original packaging. For your protection, we suggest that you inspect all merchandise at the time of delivery, before signing the Bill of Lading. When you or your representative signs the Bill of Lading without noting any damage, shortages or exceptions, you accept and own the merchandise, as delivered. The damaged merchandise should remain at the consignee’s facility (and not forwarded to another site) until the damage issue is resolved.

CONCEALED FREIGHT DAMAGE:

Should damage be discovered after delivery, you (the consignee) are responsible for filing a written Concealed Damage Claim with the carrier, requesting the carrier to make an inspection and create a damage report. Please retain all packaging until the damage issue is resolved with the carrier. This must be done within 3 days after the delivery date. Filing this claim is your responsibility, however, we will help you with the process and act as your advocate in reaching a satisfactory resolution with the carrier. The damaged merchandise should remain at the consignee’s facility (and not forwarded to another site) until the damage issue is resolved.

SHIPPING:

Prices are FOB Factory for the Continental United States only. Shipping to Alaska and Hawaii is extra. Hekman Contract will determine the best method and carrier. All orders will be shipped complete unless otherwise indicated. Hekman Contract is not liable for any delays or failure to deliver by the carrier. Normal delivery is from Dock to Dock. Special requests that incur accessorial charges from the freight company , inside deliveries, lift gates, expedited deliveries, etc. are subject to additional charges. Specifically, when a lift gate is needed that will be a $350 charge. When requiring a delivery to an assisted living facility, a home, a rehab, resort or any other similar destination that will also be a $350 charge. If you cannot accept a 53’ truck/ trailer at the delivery site and/or even a pup trailer, let us know right away so we can make special arrangements for the delivery and we can get back to you with a updated freight quote. All items are shipped in cartons or placed in trays and shrink wrapped. If pallets are required, please note there will be additional cost for this service. We have 3 shipping locations: Casegoods and clocks ship from our Zeeland, MI production facility. In Stock Collection items ship from our warehouse in Lexington, NC. Upholstered items ship from our High Point, NC production facility. Please note, that if items ship via FEDX or UPS small packages, they will be invoiced per the actual charges.

Delayed Shipments

If an order is in the late stages of production or is preparing for shipment and a shipment delay is requested by the customer, there will be a .07% daily storage charge if beyond seven (7) days.

FABRIC INFORMATION:

Hekman Contract will not warrant or take responsibility for the appearance, behavior, or durability of fabrics. We do not test and approve fabrics for use. We reserve the right to reject any covering which, in our opinion, is unsuitable for upholstery purposes. We will not be held responsible for any tailoring variance that results from the application of a particular textile to a specific frame. Fabric is not inspected upon arrival. Fabric is measured and inspected when being prepared for production.

Yardage requirements that are shown on our website and on our price lists are based upon 54" wide plain fabric/zero repeats. Unusual patterns, repeats, designs, and/or bias welt will increase yardage requirements. All stripes will be applied vertically unless otherwise specified. All COM yardage requirements are approximate until the fabric is actually laid out on a pattern. You will be notified if more COM yardage is required. In no instance will Hekman Contract be responsible for additional COM yardage. If you are ordering COM fabric, please ask the mill to ship your order complete; and if the mill is indicating the fabric will come in multiple pieces, please double check with us to ensure that we can use the size pieces they have available. Multiple pieces will sometimes require more fabric to be needed as we try to match the patterns/sizes. We reserve the right to use our best judgement in determining the application of the fabric. FINISH INFORMATION:

Finish samples are available by request from your Hekman Contract sales representative, through your Hekman Contract Customer Service Rep or support@hekmancontract.com. Wood is a natural material with variations in color, grain, and texture. Finished product may differ from the samples and an exact match cannot be guaranteed. In the case of the solid surface or HPL samples, if the material is discontinued by the manufacturer, Hekman Contract will select a comparable alternative. These surfaces may vary within accepted industry standards also.

OUR TERMS:

Upon receipt of an error-free purchase order from customers with approved credit, Hekman Contract will manufacture the product requested. Our standard terms are Net 30 days pending credit approval. FOB Factory.To request an account application form, contact Hekman Contract or your Hekman Contract Sales Representative. We do accept credit card payments. If the credit card is used to prepay a deposit or prepay the entire order, there is no fee. If we need to charge a credit card for an order that is on terms there is a 2.5% fee assessed. Pricing does not include installation, sales tax, or freight. All pricing is quoted in US Dollars. Customer agrees to pay all reasonable and actual collection fees, agency fees, attorney fees and court costs. If invoice is not paid in full, Hekman Contract will no longer honor any warranties. All questions regarding credit, invoices, billing, and payment application should be directed to support@hekmancontract.com.

ORDERING:

Orders may be emailed to your Customer Service Representative (or support@hekmancontract.com) or faxed to 616-748-2642. A small order fee of $7 applies for orders under $100. If your order calls for COM fabric, a COM form is required to be sent (email, faxed) to Hekman Contract Customer Service before the order can be processed. One COM form for every fabric. Please note the fabric direction on the COM form – Topped or Railroaded - must be designated. The COM fabric needs to be shipped to our upholstery plant unless otherwise directed:

For graded in fabric, if you have fabric reserved at a mill for your order, please let us know so we can include that information on our PO to the mill.

Please be sure to include fabric, finish, hardware, door/drawer information, etc. as needed per the product specifications on your purchase order. Remember to note any enhancements that are needed – glides, moisture barriers, casters...Don’t forget to include the delivery instructions, requested delivery date, and contact information.

QUOTATIONS:

All quotations generated by the Hekman Contract Sales Department are valid for 30 days unless extended in writing. We normally have a price review/change around April 1st each year but we reserve the right to change pricing at anytime without prior notice.

ORDER CONFIRMATIONS, ACKNOWLEDGEMENTS, CANCELLATIONS, AND RETURNS:

Hekman Contract will confirm the order and asks that the confirmation document is reviewed carefully to ensure correct products, quantities, finishes, delivery address etc. If upon completing the review, there are corrections to be made, Hekman Contract should be contacted immediately. Should nothing be communicated, the order will ship as confirmed. Because Hekman Contract’s products are made to order, it is extremely important that changes / modifications be made immediately. Once material procurement and/or production has begun, orders cannot be cancelled without incurring additional fees. Made to order items are not eligible to be returned. Any return of an In Stock Collection item or clock will need to be approved in advance, will need an authorization number, and are subject up to a 35% restocking fee. You are responsible for any loss or damage that occurs in transit. Hekman Contract reserves the right to alter prices, specifications and materials without notice and at any time. Products shown in photography either in literature or on the website may show optional features that may contain a surcharge and deviate from a standard product. An acknowledgement of the order, that will include an estimated ship date, will occur after all of the fabrics/materials needed for production have been received and credit has released your order for production.

KEYS & LOCKS:

If you order a “standard” item with a lock, the key is placed in a clear plastic bag and taped to the bottom of the drawer or cabinet (if no drawer). The keys are not shipped in the lock.

If you order all of the items in a room or area keyed alike – Bedsides, wardrobes…. On the outside of the box will be a number (like a 1) and also on the item to allow the installer to match the items together. Please check with customer service – additional costs may apply.

If the order calls for Keyed Alike for the entire facility, we will send master keys. The locks will not all be the same – but the Master keys will open all of the locks. Please check with customer service – additional costs may apply.

Additional Master Keys are available for sale. Please contact your customer service representative for information.

CUSTOM ITEMS:

Minimum order quantity for a custom item is 25 units unless it is part of a larger project. We ask that you allow at least 8 weeks for production and set up time for the order.

Casegoods:

Please note, casegoods with one door are normally hinged on the right side as you are facing the unit. If you need it left hinged, you will need a special part number. Please contact Customer Service.

PROP 65:
